Agreement to Terms

By downloading, installing, or using WarpWave ("the App," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

Description of Service

WarpWave is an iOS camera and social platform that provides real-time visual effects (including Warp, Waterfall, Mirror, and BG+Scan modes), a social dueling feature (WarpDuel), AI-powered image compositing (AI Crossover), AI-powered scene generation between two users (Imagine Us), AI video animation, open challenges, a social feed, and user profiles with follow/block functionality. The App is available as a free download with optional in-app purchases.

Eligibility

You must be at least 13 years of age to use the App. By creating an account, you represent and warrant that the age information you provided during onboarding is accurate and that you are at least 13 years old. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

We do not knowingly provide the App to children under 13. Providing false age information to circumvent age restrictions is a violation of these Terms and grounds for immediate account termination.

Your Account

You are responsible for maintaining the security of your account and for all activity that occurs under your account. You may not share your account credentials, create multiple accounts, or transfer your account to another person. You must provide accurate information when creating your account.

We reserve the right to suspend or terminate accounts that we reasonably believe are being used in violation of these Terms, are associated with fraudulent activity, or are created using false information.

Your Content

You retain full ownership of all photos, videos, and other content you create using the App ("Your Content"). WarpWave does not claim ownership rights over Your Content.

License Grant

By using WarpWave's features, you grant us the following licenses:

For duels, crossovers, and Imagine Us: A limited, temporary license to process Your Content solely for the purpose of delivering the requested feature (generating a battle card, AI composite image, or AI video). This processing is automated.

For feed posts: When you share content to the social feed (including through feed consent on duels/crossovers), you grant WarpWave a non-exclusive, worldwide, royalty-free license to display, distribute, and make your content available to other WarpWave users within the App. This license exists solely for the purpose of operating the social feed and terminates when you delete the post or your account.

For profile photos: By uploading a profile photo, you grant WarpWave a license to display it to other users. If you enable Imagine Us in Settings and select your profile photo as an available photo, you additionally grant a license to use it in Imagine Us experiences initiated by other users (see "Imagine Us" section below). You can revoke the display license by removing your profile photo, and the Imagine Us license by disabling the feature or removing the photo from your Imagine Us selections.

For open challenges: By creating or responding to an open challenge, you grant WarpWave a license to display your submitted content to other users within the challenge gallery and, if applicable, the social feed.

Acceptable Use

You agree not to use the App to:

• Create, share, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, sexually explicit, or otherwise objectionable
• Create content that exploits or endangers minors in any way
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Use the App to harass, bully, stalk, or intimidate other users through duels, challenges, Imagine Us, tagging, or shared content
• Submit content that infringes on the intellectual property rights of any third party
• Attempt to reverse-engineer, decompile, or disassemble the App or its underlying technology
• Interfere with or disrupt the App's infrastructure, servers, or networks
• Use automated systems, bots, or scripts to interact with the App
• Circumvent any usage limits, content moderation, rate limits, or access restrictions
• Create multiple accounts, share accounts, or use another person's account
• Provide false age information to circumvent age restrictions
• Use the App for any commercial purpose without our prior written consent

WarpWave reserves the right to remove content, restrict features, and suspend or terminate accounts for users who violate these Terms, without prior notice.

WarpDuels

WarpDuels are shared experiences between two users. By participating in a duel, you understand that your submitted scan will be visible to the other participant via a battle card. Both participants must separately consent before a duel can be shared to the public feed. Duels expire automatically and are deleted from our systems within 7 days of expiration.

You are responsible for any content you submit through a duel. Do not submit content that you would not want another person to see.

Open Challenges

Open Challenges allow Pro users to post a creative prompt to the feed that other users can respond to. By creating a challenge, you understand that your submitted content will be visible to all users and that other users' responses will be displayed alongside your original content. By responding to a challenge, you understand that your response may be visible to all users within the challenge gallery.

User Tagging

Users may tag other users in their solo posts. If you are tagged, you will receive a notification. You can remove your tag from any post at any time, which fully disassociates you from that content.

Content Moderation

WarpWave uses automated systems (Google Cloud Vision, OpenAI GPT-4o-mini) to review content for compliance with our acceptable use policy. We also maintain a user report system. Content that is flagged by automated moderation or user reports may be rejected, removed, or result in account restrictions without notice.

We make reasonable efforts to moderate content but do not guarantee that all objectionable content will be detected or removed. You may encounter content that you find offensive or objectionable. You can block users and report content using the tools provided in the App.

In-App Purchases

WarpWave Pro is an optional auto-renewing subscription ($9.99/year) that unlocks premium features including the ability to initiate duels, premium scan line skins, watermark-free saves, and the ability to create Open Challenges. Subscription pricing is displayed in the App at the time of purchase.

AI Credits are consumable in-app purchases that allow you to generate AI composite images and videos. Credits are non-refundable once successfully used to generate content. Credits may be automatically refunded when AI generation fails due to technical errors, timeouts, or service unavailability. A one-time courtesy refund may be issued for a user's first content moderation rejection. Subsequent moderation rejections consume the credit.

All purchases are processed through the Apple App Store. Billing, renewals, and cancellations are handled by Apple in accordance with their terms and conditions. To manage your subscription or request a purchase refund, contact Apple directly through the App Store or your device's Settings → Subscriptions.

Account Deletion

You may delete your account at any time using the self-service Delete Account feature in Settings. Account deletion is permanent and irreversible. Upon deletion:

• Your profile, username, and all associated data are permanently removed
• Your posts are soft-deleted from the feed
• Your follows, blocks, and social connections are severed
• Your remaining AI credits are forfeited
• Tags on other users' posts are disassociated
• An anonymized audit trail is retained for compliance and abuse prevention

If you have an active WarpWave Pro subscription, you must cancel it separately through Apple before deleting your account to avoid continued billing.

Intellectual Property

The App, including its design, code, visual effects, algorithms, branding, and all related intellectual property, is owned by WarpWave and protected by copyright and other applicable laws. You may not copy, modify, distribute, or create derivative works based on the App.

The WarpWave name, logo, and associated branding are trademarks of WarpWave. You may not use them without prior written permission, except to share or reference content you have created with the App.

Copyright Complaints

If you believe content on WarpWave infringes your copyright, please contact us at support@warpwave.app with:

• A description of the copyrighted work
• The location of the infringing content within the App (post ID, username, or screenshot)
• Your contact information
• A statement that you have a good faith belief the use is not authorized
• A statement under penalty of perjury that the information is accurate and you are the rights holder

We will review and respond to valid copyright complaints in accordance with applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless WarpWave and its developers, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the App
• Your Content
• Your violation of these Terms
• Your violation of any rights of any third party
• Any claim that Your Content caused damage to a third party

This indemnification obligation will survive termination of your account and these Terms.

Limitation of Liability

Dispute Resolution & Arbitration

Informal Resolution First

Before initiating any formal dispute resolution, you agree to first contact us at support@warpwave.app and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If we cannot resolve the dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in the State of California. The arbitrator's decision shall be final and binding.

Class Action Waiver

Exceptions

Either party may bring claims in small claims court if the claims qualify. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

Termination

You may stop using the App at any time by uninstalling it. You may delete your account and all associated data using the Delete Account feature in Settings.

WarpWave reserves the right to suspend or terminate your access to the App at any time, for any reason, without prior notice — including for violation of these Terms, safety concerns, or at our sole discretion. Accounts may also be automatically restricted if multiple users report violations.

Upon termination, your right to use the App ceases immediately. Any active duels, pending AI generations, or remaining credits may be forfeited.

Changes to These Terms

WarpWave may update these Terms from time to time. If we make material changes, we will notify users through an update to the App or a push notification. The effective date at the top reflects the most recent revision. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App and delete your account.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WarpWave regarding the App and supersede all prior agreements or understandings.
